Careless Driving (HTA: 130)

Understanding Careless Driving Charges

What is Careless Driving?

In Ontario, careless driving is defined under the Highway Traffic Act as driving a vehicle without due care and attention or without reasonable consideration for other persons using the highway. This broad definition can encompass a wide range of driving behaviours, from minor lapses in attention to more serious offences.

Penalties for Careless Driving

The penalties for careless driving in Ontario can be severe and may include:

  • Fines: Up to $2,000.
  • Demerit Points: 6 demerit points on your driving record.
  • License Suspension: Possible suspension of your driver’s license for up to two years.
  • Jail Time: In some cases, up to six months in jail.

Why Fight a Careless Driving Charge?

1. Protect Your Driving Record

Traffic violations, including the associated number of demerit points, are recorded on your driver’s abstract. Accumulating demerit points may result in your license being suspended.

2. Avoid possible jail time

The offence of Careless Driving may result in imprisonment of up to 6 months.

3. Avoid additional license suspension

Upon being convicted, your license may be suspended a period of up to 2 years.

4. Avoid higher insurance premiums

Your driver’s abstract is monitored by the Government of Ontario and is used by insurance companies to determine your insurance premiums. Traffic violations and the associated number of demerit points are recorded on your driver’s abstract, which may result in increased insurance costs.
